1. Acceptance of Terms
By accessing and using ePAL's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
ePAL provides eCommerce compliance services targetted at businesses selling cross border, including:
- Calculation of indirect Tax and/or Customs duties.
- Shipping, documentation and labeling services
- Customs declarations and handling
- VAT registration and reporting
- Refunds and returns management
- Compliance screening and reporting
- Analytics and reporting tools
3. User Responsibilities
You agree to:
- Provide accurate and complete information about your shipments
- Comply with all applicable laws and regulations
- Pay all fees and charges in a timely manner
- Not use our services for illegal or prohibited goods or purposes
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
4. Fees and Payment
Our pricing is based on a pay-as-you-go model:
- No setup fees or monthly minimums
- Charges apply per shipment processed
- Subscription-based accounts must maintain a positive balance
- All fees are due upon invoice
- Late or declined payments may incur additional charges
- Disputed charges must be reported within 30 days
5. Limitation of Liability
ePAL's liability is limited to the fees paid for the specific service in question. We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption. ePAL is not liable for any penatlies, fees or charges applied by Tax or Customs administrations, except in cases where ePAL has provided a "Guaranteed Duty Delivery Paid" service, over and above the basic ePAL servive and a separate fee has been paid for this additional service.
6. Termination
Either party may terminate this agreement with 30 days written notice. ePAL may terminate immediately for breach of terms, non-payment, or illegal activity. Upon termination, you remain liable for all outstanding fees.
7. Governing Law
These terms are governed by Irish law. Any disputes will be resolved in the courts of Ireland.
